Maharashtra has finalised the blueprint for the largest-ever crackdown in the state's history on the illegal trade in banned gutka. For the first time, those selling gutka will be booked under the Maharashtra Control of Organised Crime Act (MCOCA). Food and Drug Administration (FDA) Commissioner Tukaram Mundhe has issued an order on the matter, making it clear that action will be taken against the entire chain linked to the gutka business.
Who Will Fall Under MCOCA?
Under this drive, manufacturers, sellers, those providing financial backing, suppliers, commission agents, transporters, their agents, warehouse operators, smugglers and traders will all be brought within the ambit of MCOCA. The official said that despite a complete ban on gutka in the state, its illegal trade continues unchecked. Numerous cases have been registered so far, action has been taken and prosecutions have been pursued, yet the network remains active, posing a serious threat to public health.
Drive to Begin From This Date
The FDA has directed that a tough campaign against the gutka trade be launched across Maharashtra from June 12. The action will not be limited to small vendors but will target the entire organised network. For this, MCOCA will be used alongside the relevant sections of the Food Safety and Standards Act (Food Safety Act) and the Bharatiya Nyaya Sanhita (BNS). Food safety officers have also been instructed to play an active role in the campaign. In his order, the Commissioner has cited Article 47 of the Constitution, which describes improving public health as a primary duty of the state.
Action Taken So Far
According to the figures, 703 FIRs linked to the gutka trade have been registered in Maharashtra over the past ten years. Of these, 260 cases were filed against manufacturers, 248 against suppliers and 190 against transporters. Now, examining the organised-crime angle in these cases, action will also be taken under MCOCA. This decision is being seen as the strictest action yet against the illegal gutka trade in Maharashtra.
