A special Delhi court on Wednesday reserved its verdict on an application filed by the Anti-Corruption Branch (ACB) seeking 14 days of judicial custody for former minister Satyendar Jain, former Delhi Jal Board (DJB) Chief Executive Officer Udit Prakash Rai, and three other co-accused in an alleged corruption case. The matter pertains to alleged irregularities and corruption in the tender process for sewage treatment plant (STP) projects under the DJB. Special Judge Dig Vinay Singh reserved the order after hearing detailed arguments from both the prosecution and defense teams.
Remand Plea and Action Against Accused
During the court proceedings, the anti-corruption agency requested judicial custody for five of the six arrested individuals. However, the ACB specifically sought police remand for only one accused person, Ankit Shrivastava, a former contractual consultant with the Delhi Jal Board, to enable further custodial interrogation. The six individuals arrested in connection with the investigation include Aam Aadmi Party (AAP) leader Satyendar Jain, former CEO Udit Prakash Rai, Ankit Shrivastava, Nagendra Yadav, Raja Kumar Kurra, and Pankaj Verma. The special court reserved its decision on the custody requests following the submission of these arguments.
Defense Arguments Challenging Arrest of Satyendar Jain
Counsel representing Satyendar Jain strongly contested the ACB's remand plea and questioned the legal grounds for his client's arrest. The defense lawyer pointed out to the court that while the initial First Information Report (FIR) was registered on May 10, 2024, the investigation agency called his client for questioning for the first time much later, on August 5, 2026. The attorney added that Jain was called for a second time via a telephone call on Tuesday, after which he was formally taken into custody. The defense maintained that the ACB possessed no concrete material or justification to warrant the arrest.
Legal Position of Co-Accused
The legal counsel for former DJB CEO Udit Prakash Rai also challenged the validity of his client's arrest before the special judge. The attorney informed the court that Rai is currently serving as a Secretary in the Government of Mizoram and argued that the detention was unwarranted. Similarly, advocates representing the other co-accused individuals, including Nagendra Yadav, Raja Kumar Kurra, and Pankaj Verma, raised objections against the grounds of arrest submitted by the agency, arguing that the allegations did not justify their continued custody.
Allegations in Sewage Treatment Plant Tender Process
The corruption case was formally registered on May 11, 2024, based on a complaint forwarded by the Directorate of Vigilance. The investigation centers on alleged widespread irregularities, deliberate manipulation of tender conditions, and criminal conspiracy during the procurement process for expanding and upgrading sewage treatment plants under the DJB. According to findings submitted by the ACB, specific technical parameters and tender criteria were tailored to favor a single technology provider company, Euroteck Environmental Private Limited. The probe agency emphasized that this restriction undermined fair competition and resulted in undue commercial benefits for the private firm.
