The Central Consumer Protection Authority (CCPA) has launched a massive, nationwide crackdown against 41 restaurants and cafes for illegally forcing customers to pay a service charge. Taking serious note of widespread consumer frustration, the regulatory body has decisively stepped in to halt the stubborn industry practice of automatically burying these discretionary fees within food bills. This major regulatory sweep aims to protect diners from predatory pricing tactics and ensure that dining establishments operate with complete financial transparency.
Massive Fines and Software Overhauls
Leading the list of penalised establishments is the popular tea cafe chain Chaayos, which is officially operated by Sunshine Teahouse Private Limited. The CCPA has taken strict coercive action by slapping a monetary fine of Rs 50,000 on the company for blatantly violating basic consumer rights. However, the regulatory body did not stop at just financial penalties. The authority has explicitly mandated that Chaayos must track down and refund the illegally collected money to the affected customers who were forced to pay the extra amount. Moreover, the cafe chain has been legally directed to completely overhaul its software-based automated billing systems across all its physical outlets. This technical fix is required to ensure that the system no longer defaults to adding a service charge when generating a final receipt.
Other Major Brands Facing the Music
While Chaayos received a specific financial penalty, it is far from the only big name facing regulatory heat. The consumer watchdog's aggressive action was heavily driven by a massive influx of grievances filed by angry diners through the official National Consumer Helpline (NCH). Acting on this data, the CCPA has successfully passed final, binding orders against several other prominent eateries and premium hospitality brands that were caught engaging in the exact same billing tricks.
The official list of offenders includes massive national chains like Fiesta Barbeque Nation, which operates under Barbeque Nation Hospitality Private Limited, as well as China Gate Restaurant Private Limited and the premium dessert chain L'Opera French Bakery Private Limited. The regulatory dragnet also caught major regional hotspots. Action has been firmly taken against Cafe Blue Bottle located in Patna, Foo Ahmedabad Restaurant (managed by Pebble Street Hospitality Private Limited), and Zoro - The Luxury Night Club (operated by Rudra Hospitality Private Limited).
Government Warns Against Forced Fees
Union Consumer Affairs Minister Pralhad Joshi publicly addressed the ongoing crackdown, taking to social media to reiterate the central government's incredibly strict stance on the issue. Delivering a clear message to the public, he stated, "Service charge is completely voluntary, and whether to pay it or not depends entirely on the consumer." The minister emphatically confirmed that the CCPA has already formally instructed the offending restaurants to put an immediate, permanent end to the automatic inclusion of these hidden fees.
Furthermore, the Ministry of Consumer Affairs has issued an official public statement confirming that this initial wave of 41 orders is just the beginning. Detailed investigations are actively continuing against a wide array of other restaurants that have been recently flagged by frustrated customers, suggesting more fines and directives are imminent.
Strong Legal Backing and Previous Warnings
The stubborn industry practice of adding a service charge without securing explicit, prior customer consent is a direct and blatant violation of the comprehensive CCPA guidelines that were initially issued back in 2022. Under the strict provisions of Section 2(47) of the Consumer Protection Act, 2019, such deceptive billing actions are officially and legally classified as an unfair trade practice.
This recent, sweeping regulatory action is strongly backed by the judiciary. A landmark Delhi High Court judgment delivered in March 2025 fully upheld the CCPA's consumer-friendly rules. The court definitively declared that there is absolutely no legal foundation or statutory right for restaurants to impose a mandatory service fee, officially cementing the rule that all eateries must abide by consumer choice.
