Former Tehelka magazine editor Tarun Tejpal, aged 63, has filed a petition in the Supreme Court challenging his conviction and sentence in connection with the 2013 Goa rape case. The appeal directly contests the verdict of the Bombay High Court, which on August 6 found Tejpal guilty of rape and sentenced him to 10 years of rigorous imprisonment along with a fine of 10 lakh rupees. Through this decision, the High Court had overturned a five-year-old ruling by the trial court that had previously acquitted the former magazine editor of all charges.
High Court Judgment and Stringent Penalty
During the proceedings, the Bombay High Court bench emphasized that the victim's statement was entirely credible and trustworthy. The court noted that 63-year-old Tarun Tejpal occupied a position characterized by trust, authority, and dominance over the victim. Taking these factors into consideration, the bench determined that the severe sentence of 10 years of rigorous imprisonment and the monetary fine of 10 lakh rupees were warranted under the law, thereby reversing the lower court's exoneration.
Criticism of Trial Court Approach
The High Court expressed serious concern over how the sessions court had conducted the initial trial. It observed that the trial court had placed an undue degree of focus on the victim's character rather than concentrating strictly on the merits of the allegations. The High Court benchmarked this flaw by remarking that it appeared as though both the victim and the accused were undergoing trial simultaneously, a practice the appellate bench found highly improper.
Power Dynamics and Intrusive Cross-Examination
Furthermore, the High Court strongly criticized the repetitive and intrusive cross-examination that probed deeply into the victim's private life during the trial court proceedings. The bench highlighted that the key factors in the case revolved around power dynamics and the clear abuse of authority. Following these findings by the High Court, Tarun Tejpal has now approached the Supreme Court seeking relief from the conviction and penalty.
