The Goa bench of the Bombay High Court has sentenced Tarun Tejpal, the former editor-in-chief of Tehelka news magazine, to 10 years of rigorous imprisonment in connection with a 2013 sexual assault case involving a female colleague. This ruling overturns a decision made five years ago by a Goa sessions court, which had previously acquitted Tejpal of all charges. Alongside the prison term, the High Court imposed a fine of ₹10,21,000 on Tejpal, directing that the full compensation amount be paid directly to the victim.
Surrender Timeline and Sentencing Considerations
The High Court division bench, comprising Justice Nila Gokhale and Justice Amit Jamsandekar, initially ordered Tejpal to surrender within two weeks of the ruling. However, following a formal plea submitted by his legal representatives, the court granted an extension, raising the surrender period to four weeks.
In deciding upon the minimum statutory sentence, the bench took several contextual factors into account. The judges observed that the incident occurred 13 years ago and noted that Tejpal had not committed any subsequent offenses during the intervening period. The court further reflected that after more than a decade, both the survivor and Tejpal have likely moved forward with their respective personal lives.
Tejpal's Defense and Legal Response
Reacting to the conviction, Tejpal rejected the judgment and maintained his innocence, claiming that the prosecution was unjust and politically motivated due to past investigative work published by Tehelka magazine. He expressed confidence in contesting the verdict through higher legal channels, stating, "This is a wrong case against me. We will fight, and I have faith in the judiciary."
Tejpal asserted that exonerating evidence presented by his defense had not been evaluated correctly. He argued that investigative reporting by his publication had made him a target for political retribution, drawing parallels to other prolonged detentions by mentioning that individuals like Umar Khalid and Sharjeel Imam have remained imprisoned for years. Tejpal reaffirmed his intention to pursue all available legal remedies to challenge the conviction.
