He said that the documents related to Sonam's arrest mistakenly cited Section 403(1), a section that does not exist in law, instead of Section 103(1), which deals with murder. The government called it a purely clerical error and argued that the mistake did not cause any prejudice to the accused's rights. Its entire argument rested on the claim that this was a typing slip and not a deliberate lapse.
What the court will now examine
The Supreme Court will now closely review the entire legal process followed during Sonam's arrest, along with the grounds of arrest that were recorded at the time. Based on this review, the court will decide whether her bail continues to stand or whether she has to go back to jail. This means the matter is no longer limited to the typing error alone, the Supreme Court will also weigh in on whether the reasons given for her arrest were valid.
What happened earlier
The Supreme Court had earlier rejected the Meghalaya government's request for an interim stay on Sonam's bail, reasoning that she had already been released on bail. However, the court had also observed that, prima facie, it did not appear that the grounds of arrest were not stated at all. The court further questioned why, if there truly was such a major lapse in the arrest process, the issue had not been raised in the earlier bail petitions.

For now, the court has made it clear that Sonam must decide before the next hearing whether she wants to surrender or wait for a decision on merits. The hearing scheduled for July 23 will bring more clarity on this front. Until then, uncertainty will continue to hang over her bail, and it remains to be seen whether the typing error argument holds up in court.
