A resident of Meghalaya has formally approached local law enforcement authorities to seek the registration of a formal police complaint regarding an alleged physical assault by an official of the Enforcement Directorate during a questioning session. The legal representation representing the individual has submitted a detailed complaint to initiate an official probe into the matter.
Summons and Appearance Before Authorities
The formal complaint was initiated by advocate Niksrang Ch. Marak on behalf of his client, Sansilstone Sangma. The individual had appeared before the Enforcement Directorate on August 27 in compliance with a summons issued to record his official statement. According to the legal representative, Sangma cooperated fully with the investigative proceedings throughout the interaction.
Allegations of Physical Force
The complaint explicitly alleges that Sangma was subjected to physical assault during the interrogation by Shekar Kumar, who has been identified as an investigating officer or official associated with the Enforcement Directorate. The documentation asserts that Sangma offered no resistance or obstruction during the questioning process, rendering the alleged use of force completely unwarranted and disproportionate to the situation.
Medical Examination and Treatment
Following the alleged incident, Sangma reportedly experienced physical pain along with swelling and injuries to his forearm and hand. He was subsequently transported to Civil Hospital, Shillong, to undergo a comprehensive medical examination and receive necessary treatment. The legal counsel has urged the police to formally obtain all medical records, injury reports, prescriptions, and related documentation from the hospital as a vital part of the ongoing investigation.
Preservation of Electronic and CCTV Evidence
A significant portion of the complaint is dedicated to requesting the immediate preservation of CCTV footage from the premises of the Enforcement Directorate. The lawyer emphasized that recordings covering the specific room, corridors, entry and exit points, and surrounding areas could serve as crucial evidence. Law enforcement was urged to secure original CCTV recordings, including server backups and data from the relevant date and time, to prevent any potential deletion, overwriting, alteration, or destruction of the digital evidence.
Demand for Fair Investigation and Legal Action
The complaint further calls for the identification and thorough examination of other ED officers, staff members, and individuals who were present in or around the location at the time of the alleged occurrence. Marak stated that the grievances outlined by his client prima facie disclose cognizable offences under the Bharatiya Nyaya Sanhita, 2023, and other applicable legislative provisions. However, the determination of specific offenses and sections has been left to the investigating officer based on medical evidence, witness statements, and collected material.
The lawyer has pressed for the prompt registration of an FIR, a fair and unbiased investigation, the securing of all electronic and documentary records, and the examination of the implicated ED officer. Furthermore, the petition requests appropriate legal action against any party found culpable, alongside an acknowledgement of the complaint and a copy of the registered FIR.
