In a major regulatory crackdown on the unmonitored online sale of hazardous materials, the Central Consumer Protection Authority (CCPA) has penalized the commercial e-commerce platform Dial4Trade with a fine of ₹10 lakh. The action comes after an investigation revealed that the platform allowed the open listing and sale of ammonium nitrate, a key chemical component used in manufacturing explosives, without mandatory safety verifications or regulatory clearances.
Unlicensed Sale of High-Risk Explosive Chemical
The regulatory inquiry established that ammonium nitrate was offered on Dial4Trade without the required Petroleum and Explosives Safety Organization (PESO) license. Alarmingly, the platform failed to implement any protocol to verify the credentials or identity of prospective buyers. Anyone could place an order for this sensitive compound without undergoing background checks or presenting safety documentation. Regulators emphasized that such unmonitored access to high-risk explosive chemicals posed a significant threat to national security.
Misleading Product Listings and Blast Imagery
The CCPA investigation highlighted egregious flaws in how the product was presented on the portal. Ammonium nitrate was displayed alongside ordinary goods, masking its dangerous nature. Furthermore, the listing featured promotional images showing explosions and blasts. Crucially, the platform omitted all statutory disclosures regarding legal purchasing requirements, regulatory restrictions, and essential buyer licensing. Consequently, the CCPA classified this presentation as a misleading advertisement and an unfair trade practice.
Rejection of B2B Status and Safe Harbor Defenses
In response to the regulatory notice, Dial4Trade argued that it operates purely as a B2B marketplace and that individual sellers bear sole legal responsibility for listed products. The company also invoked safe harbor protections provided under the Information Technology Act. However, the CCPA firmly rejected these arguments, pointing out that the platform enabled purchases as small as a single unit without confirming whether the buyer was a legitimate registered business entity. The authority ruled that for controlled, high-risk chemicals, reactive post-complaint takedowns are insufficient, establishing that platforms must perform strict pre-listing verification. The CCPA reaffirmed that online buyers rely on site information and ordered the immediate cessation of all ammonium nitrate and explosive sales.
Broader Industry Scrutiny on Major E-Commerce Platforms
The punitive measure against Dial4Trade has triggered widespread scrutiny across India’s digital marketplace sector. The CCPA has expanded its oversight to evaluate compliance standards across multiple leading B2B and e-commerce platforms. Major entities currently under the regulatory radar include IndiaMART, Justdial, and TradeIndia, alongside portals such as Exporters India and Alpha Chemika. Authorities aim to ensure comprehensive compliance to prevent online commercial tools from being exploited for illegal or dangerous activities.
