Legal troubles have once again escalated for former WFI president and BJP leader Brij Bhushan Sharan Singh as four female wrestlers have formally challenged his acquittal in a sexual harassment case. Taking up the petition filed by the female wrestlers, the Rouse Avenue session court conducted a hearing and issued formal notices to both Brij Bhushan Sharan Singh and co-accused Vinod Tomar, demanding their official responses. The session court has directed both individuals to submit their respective replies by October 9, setting the stage for the next crucial hearing on the same date, where further proceedings will take place based on their submissions.
The Magistrate Court Acquittal
Previously, the magistrate court had cleared Brij Bhushan Sharan Singh of all charges related to the allegations of sexual harassment. Dissatisfied with that outcome, four female wrestlers moved the session court by filing an appeal. Through this legal challenge, they have urged the court to set aside the previous decision that had cleared the BJP leader and former WFI president. The session court will resume its examination of the matter on October 9 once the formal responses from the accused parties are placed on record.
Allegations of Speculation Against Lower Court
In their detailed appeal, the female wrestlers contended that the ruling delivered by the lower court was heavily dependent on assumptions and conjectures rather than solid facts. Furthermore, the petition points out that the earlier judgment reflected outdated and conservative mindsets regarding how victims of sexual harassment and abuse are conventionally expected to behave in society.
Focus on Minor Inconsistencies
The legal filing argues that while dismissing the prosecution case, the lower court chose to fixate narrowly on minor discrepancies and isolated inconsistencies. Instead of conducting a holistic evaluation of all available evidence and considering the substantial backing provided by witnesses, the lower court overlooked key aspects of the investigation, according to the petitioners.
Filing of the Initial FIR in 2023
The entire controversy originated when six female wrestlers came forward with formal allegations of sexual harassment against Brij Bhushan Sharan Singh. Acting promptly on their complaints, the Delhi Police registered an FIR and subsequently filed a charge sheet against Brij Bhushan on June 15, 2023, under sections 354, 354A, 354D, and 506(1) of the IPC for the alleged offenses.
