The Supreme Court has taken strict action regarding remarks made against the Chief Justice of India and the judicial system. The apex court has issued formal notices to Uddhav faction Shiv Sena Rajya Sabha MP Sanjay Raut and journalist Nikhil Wagle, seeking their explanations. The court specifically asked both individuals why contempt proceedings should not be initiated against them in light of their controversial statements. During the proceedings, the bench observed that people often fail to realize how they are being drawn into a calculated trap.
Hearing on SCBA Criminal Contempt Petition
The legal proceedings stem from a criminal contempt petition filed by the Supreme Court Bar Association. During the court session, Solicitor General Tushar Mehta submitted that certain individuals engage in such actions deliberately under the impression that it might exert pressure on the judiciary. The bench examined the arguments presented before it and decided to seek formal responses from the respondents concerning their alleged remarks against the institution and its leadership.
Arguments and Submissions in Court
Appearing for the Supreme Court Bar Association, senior advocate Pradeep Rai stated before the bench that filing such a petition was a painful task for them. He pointed out that the respondents involved include a member of parliament and a prominent journalist. He further argued that personal appearance of the respondents should be made mandatory, warning that ignoring such conduct at this stage could embolden others to follow a similar path. Following these discussions, the court directed the notices to be issued.
Exemption from Personal Appearance
While issuing the notice asking why contempt action should not be taken, the court granted temporary relief by exempting both Sanjay Raut and Nikhil Wagle from personal attendance at this stage. Emphasizing the broader context of the controversy, the bench remarked that people do not seem to understand that they are being trapped into situations they cannot foresee.
Background of the Controversy
The controversy originated from statements made by Sanjay Raut concerning the judiciary. He had publicly criticized the CJI for declining to meet Rahul Gandhi and other opposition leaders over issues related to the functioning of the Election Commission. Furthermore, he had claimed that around 80 judges from the Supreme Court and various high courts were allegedly seen playing badminton with political leaders in London, which triggered widespread discussions and subsequent legal action.
