The legal confrontation surrounding the film title 'Kala Hiran: The Battle for Legacy' has escalated further, with the Delhi High Court directing Hindi cinema actor Salman Khan to submit a formal response. The dispute centers on a cinematic project linked to the widely reported 1998 blackbuck case, pitting the actor against the filmmaker in a battle concerning personal rights and artistic freedom.
Producer Amit Jani Moves Plea to Halt Proceedings
Film producer Amit Jani approached the Delhi High Court seeking an interim stay on the civil suit instituted by Salman Khan. The application came up for hearing on Tuesday before the single judge bench presided over by Justice Anup Jairam Bhambhani. During the court proceedings, legal counsel representing the producer urged the bench to place a temporary freeze on the hearing of the lawsuit.
Advancing their arguments, counsel for Jani submitted that an identical relief and similar demands are already pending adjudication in another matter previously filed before the high court. The producer's legal team contended that until that earlier petition is conclusively resolved, the present suit involving Salman Khan ought not to proceed. They submitted that allowing parallel proceedings on overlapping subject matters would cause prejudice, making it necessary to pause the actor's lawsuit until clarity emerges from the prior case.
Personality Rights and the Actor's Legal Stand
During the courtroom deliberations, the bench specifically examined the nature of the reliefs sought by the actor in his original suit. The court inquired whether the action was primarily intended to safeguard Salman Khan's personality and privacy rights. Addressing this inquiry, Senior Advocate Ravi Prakash, appearing on behalf of the actor, clarified the timeline and scope of their claim.
The senior counsel informed the bench that the original lawsuit was indeed initiated to protect the actor's personality rights, highlighting that the court had previously granted favorable orders protecting those interests. Prakash explained that subsequent to those court protections, the announcement of this new film came to light, which was portrayed as being directly connected to an event from the actor's life. Consequently, the legal team had to approach the court seeking restraining reliefs against the film project.
Objections Based on Public Statements and Next Date
The actor's representation pointed out that their objections to the cinematic venture were supported by tangible material already on record. When pressing for relief against the film, the actor's side cited public statements and media interviews given by the producer, which explicitly linked the storyline to past incidents concerning the actor. Salman Khan's team maintained that these very statements justified their plea for protective court intervention.
Upon considering the initial submissions from both sides, the Delhi High Court directed senior advocate Ravi Prakash to place on record a written reply to the interim stay application filed by producer Amit Jani. The court has now scheduled the next hearing in the dispute for 16 December, when further arguments will be taken up.
