The makers have decided to challenge a recent Delhi High Court order that instructed them to take down the film's teaser, promotional assets, and interviews featuring producer Amit Jani.
The Core Dispute and Salman Khan's Petitions
The plot of the movie draws inspiration from the high-profile 1998 blackbuck poaching case. Prompted by this, Salman Khan approached the Delhi High Court, alleging that the promotional campaign utilized various markers associated with his personal identity without permission, thereby infringing upon his personality and publicity rights. According to the petition, the promotional material and teasers are designed in a way that viewers can instantly draw parallels with the actor.
The petition pointed out specific elements, noting that a character in the film sports a blue bracelet which is widely recognized as Salman Khan's signature accessory. Furthermore, another poster depicts the character holding a rifle. The actor argued that such promotional tactics could mislead the public and adversely affect his reputation. Notably, he was previously acquitted in the arms act case connected to the blackbuck incident.
High Court Observations and Directives
During the hearings, the Delhi High Court issued strict directives to remove all online links associated with the teaser. It also ordered the removal of promotional interviews given by producer Amit Jani. In its oral observations, the bench stressed that safeguarding an individual's reputation is paramount and questioned why symbols resembling Salman Khan were incorporated into the movie's marketing campaign.
Makers' Stance and Freedom of Expression
Weighing in on the legal battle, director Bharat S Shrinet stated that his team holds the judiciary and the law in the highest regard. He acknowledged that every individual possesses the right to protect their identity and honor. However, he emphasized that the Constitution also grants filmmakers the fundamental right to freedom of speech and creative expression.
This friction between individual rights and creative liberties is what has prompted the team to move the Supreme Court.
