In a significant legal development concerning the high-profile Kanhaiya Lal murder case of Udaipur, the Rajasthan High Court has taken a stern stance by dismissing the bail petitions filed by five accused persons. The incarcerated individuals had approached the court seeking release on bail during the ongoing proceedings. However, taking into account the arguments presented by the prosecution and the gravity of the charges, the bench refused to grant any interim relief, ensuring that all five individuals continue to remain behind bars.
Matter Heard Before Division Bench
The batch of bail applications was taken up for hearing before a Division Bench of the Rajasthan High Court. Chief Justice Sanjay K. Agrawal and Justice Sameer Jain presided over the bench that evaluated the pleas. During the court proceedings, both the defence counsel and the prosecution advanced extensive arguments concerning the merits of the case. After duly examining the records and hearing the submissions from both sides, the Division Bench declined to extend any indulgence and ordered the dismissal of the petitions.
The Five Accused Denied Relief
The judicial order impacts five distinct accused who had approached the court for bail. Among those whose petitions were turned down are Muslim Khan, Aasif Hussain, and Mohammad Mohsin. Furthermore, the bench also rejected the bail pleas preferred by Mohsin Khan and Wasim Ali. All five accused had sought regular bail through separate filings, but the high court found no sufficient grounds to entertain their prayers at this stage of the judicial process.
NIA Opposes Bail Petitions in High Court
The National Investigation Agency, commonly known as the NIA, is the premier agency conducting the probe into the murder of Kanhaiya Lal. Following the incident in Udaipur, the entire investigation was officially entrusted to the NIA to uncover all aspects of the case. During the hearing in the high court, Special Public Prosecutor Snehdeep Khyaliya appeared on behalf of the agency. Special PP Snehdeep Khyaliya placed the agency's stance and legal objections before the bench against the grant of bail. With the dismissal of these pleas, the trial and related proceedings will progress without the release of these five accused.
