Securing permanent residency in the United States through capital investment is set to become significantly more expensive for foreign entrepreneurs and families. The US Citizenship and Immigration Services (USCIS) has authorized major fee hikes across multiple petitions tied to the EB-5 Immigrant Investor Program. These revised rates will formally take effect on November 30, 2026, escalating the upfront and post-approval administrative expenses for applicants pursuing green cards via this channel.
Sharper Tariffs on Initial Investor Petitions and Condition Removals
For standalone applicants filing an initial Form I-526, the filing cost will jump from 3,675 dollars to 7,615 dollars. Meanwhile, investors participating through designated regional entities face an even steeper change, as the fee for Form I-526E climbs from 3,675 dollars to 7,850 dollars. Both categories of initial immigrant petitions will also incur a mandatory 75 dollars technology fee. The financial escalation continues at the conditional stage: Form I-829, utilized by investors to remove conditions on their green cards, will see its processing charge advance from 3,750 dollars to 5,000 dollars.
Substantial Hikes for Regional Centre Approvals and Project Filings
The regulatory adjustment places a hefty fiscal burden on regional centers as well. Securing initial administrative designation through Form I-956 will require 44,115 dollars, up from the current 17,795 dollars. Similarly, filing Form I-956F to register an actual project development plan will now carry an adjusted price tag of 42,675 dollars. USCIS operates primarily on petition revenue, utilizing these collections to cover operational expenses such as background investigations, petition adjudication, eligibility verification, and anti-fraud enforcement measures.
Understanding the EB-5 Framework and Capital Thresholds
The EB-5 immigrant category allows foreign nationals to obtain lawful permanent residence by deploying capital into qualifying American commercial enterprises while generating a minimum of 10 full-time jobs. Under governing standards, standard commercial projects demand a baseline outlay of 10.5 lakh dollars (1.05 million dollars). In designated targeted employment areas or approved infrastructure undertakings, the capital threshold stands at 8 lakh dollars (800,000 dollars). Successful petitions cover the primary investor alongside their spouse and qualified unmarried children under the age of 21.
Implications for High-Demand Markets and Prospective Applicants
Demand for the EB-5 program from regions such as India has accelerated rapidly over recent years. This heavy volume has already created visa backlogs that influence overall processing timelines and waiting periods. The newly approved upward revision in application expenses will notably increase the total administrative outlay for prospective investors. While government processing fees are increasing sharply, the underlying statutory criteria regarding mandatory capital amounts and the creation of ten full-time jobs remain entirely unchanged under current law.
