In a major legal and administrative reform designed to spur commercial activities and drive economic growth across the state, the government of Madhya Pradesh has introduced comprehensive updates to workplace regulations. Governor Mangubhai Patel has formally granted approval to the Madhya Pradesh Workplace Empowerment Code (Shram Shakti Samhita), 2026. This legislative approval paves the way for commercial establishments, including retail shops, shopping malls, hotels, restaurants, and other business outlets, to operate 24 hours a day, seven days a week. The primary objective behind this regulatory overhaul is to enhance convenience for enterprises, attract fresh investments, generate new employment avenues, and nurture a vibrant night economy. Simultaneously, the state government has instituted clear safeguards covering employee working hours, overtime compensation, workplace health and safety protocols, and protective measures for female staff to ensure that expanded operational freedom does not lead to labor exploitation.
Round-the-Clock Business Operations Across Commercial Establishments
Under the provisions of the newly approved code, operational timing restrictions previously imposed on commercial units have been substantially relaxed. Business owners in Madhya Pradesh now possess the flexibility to keep their establishments operational day and night according to customer demand and market conditions. Allowing commercial spaces, food joints, and entertainment venues to remain open throughout the night is anticipated to invigorate retail trade, boost tourism, and revitalize civic life. However, while granting 24/7 operational freedom, the framework mandates that establishment owners fulfill specific security, lighting, and logistical requirements to maintain order and public safety during nighttime hours.
Employee Work Hour Caps, Daily Shifts, and Overtime Compensation
To prevent employee fatigue and guard against excessive work demands, the government has capped overall duty hours. The law specifies that no employee can be required to work for more than 48 hours in a single week. To maintain continuous 24/7 operations, commercial establishments are required to implement structured shift management systems. Furthermore, as outlined in the legislative provisions, an individual employee's daily duty shift cannot exceed 12 hours under any circumstances. If an employer requires staff to work beyond their standard scheduled shift, prior explicit consent from the employee is mandatory. Any work performed beyond regular hours must be compensated with additional overtime pay in full accordance with prescribed statutory rates.
Streamlined Single Online Registration and Unique Identification
To simplify administrative procedures and eliminate bureaucratic delays for entrepreneurs, the registration mechanism for business outlets has been modernized. Under the new system, commercial establishments are required to complete only a single online registration process. Upon completion, the system issues a unique identification number dedicated to that specific establishment. Should there be any subsequent changes in business details, ownership, or operational scope, owners can update their records online without re-submitting physical applications. This move eliminates repeated paperwork and reduces compliance burdens for businesses operating across the state.
Workplace Safety Protocols, Fire Compliance, and Emergency Preparedness
The code places significant emphasis on maintaining high standards of workplace safety and hygiene for both workers and visiting customers. Business owners operating round the clock must ensure proper sanitation, install fire safety equipment, and keep emergency exit pathways clearly marked and unobstructed. Establishments are also required to maintain accessible emergency response setups and first-aid supplies on site. These mandatory safety protocols aim to prevent accidents and ensure that commercial premises remain safe for public use at all times of the day and night.
Night Shift Regulations and Transport Facilities for Female Employees
Specific protective measures have been built into the legislation to facilitate female workforce participation while guaranteeing their security. Female employees are permitted to work night shifts, provided that employers adhere to strict safety guidelines. Management must ensure complete security arrangements within the premises during nighttime hours. Additionally, employers are legally obligated to provide dedicated, safe transportation services to transport female staff safely between their workplace and residences during night shifts, ensuring equal work opportunities without compromising safety.
Inclusion of Unorganized Workers and Enhanced Grievance Redressal
Beyond organized commercial units, the Madhya Pradesh Workplace Empowerment Code 2026 extends social security benefits to workers in the unorganized sector. Provisions have been made to connect auto-rickshaw drivers, domestic workers, construction laborers, and other informal workers with state-backed social welfare programs. To complement these benefits, the state is strengthening its labor grievance redressal machinery, enabling unorganized and contract workers to register complaints regarding working conditions, unpaid wages, or safety violations for prompt investigation and resolution by concerned authorities.
Inspection Powers of the Labour Department and Penalty Measures
To enforce compliance with these statutory guidelines, designated officials from the Labour Department have been empowered to conduct inspections of commercial premises. Inspectors are authorized to examine attendance registers, shift logs, overtime payment records, and physical safety arrangements. If an establishment is found violating prescribed weekly or daily work hour caps, failing to disburse overtime wages, or neglecting female safety requirements, the Labour Department holds full authority to initiate legal proceedings and impose penalties against non-compliant owners. This enforcement framework balances business flexibility with rigorous protection of labor rights.
