The incident occurred on July 25 when Justin Howard and Danielle McKinnon purchased fried chicken from the Popeyes outlet situated on South Sam Houston Parkway West. According to the legal complaint, Howard bit into a piece of chicken and immediately noticed a foreign substance inside the meat that appeared to be a condom. Overcome with nausea and distress, the couple immediately stopped eating. They suffered from severe anxiety regarding potential health contamination and had no immediate way of verifying the nature or hygiene risks associated with the meal they had been served.
Legal Action Filed in Harris County Court
Following the disturbing experience, the couple formally filed a lawsuit on August 3 in the Harris County District Court. The civil suit names three main defendants: parent corporation Restaurant Brands International, Popeyes Louisiana Kitchen, and local franchise operator Amana Businesses. The plaintiffs allege severe negligence, unsafe food handling practices, and clear violations of Texas state consumer protection laws.
Unprofessional Response from Restaurant Staff
The situation escalated further when the couple returned to the restaurant to address the issue with the management. The lawsuit states that instead of handling the serious complaint with appropriate care, store employees mocked the couple and dismissed their concerns. Rather than initiating a formal investigation or offering an immediate refund, staff members repeatedly offered to replace the meal with fresh chicken. The couple refused the replacement and insisted on a refund, which was finally processed after persistent demands.

Towards the end of July, community activists Candice Matthews and Quanell X visited the establishment to meet with outlet management. They demanded a comprehensive investigation into food preparation protocols at the site and urged management to halt all chicken sales at the South Sam Houston Parkway West location until food safety compliance could be fully verified.
