The Bombay High Court has delivered a significant ruling providing major relief to Bollywood actress Preity Zinta against the proliferation of deepfakes and manipulated online content. In a decisive move, the court has ordered the immediate removal of all unauthorized AI-generated material, tampered photographs, and forged videos featuring the actress from various digital platforms. Justice Madhav Jamdar, presiding over the single-judge bench, remarked during the hearing that the misuse of such content constitutes a direct infringement upon an individual's fundamental rights.
Holding Platforms Accountable
The court did not merely stop at ordering the removal of the content; it also issued a stern warning to online platforms and intermediaries regarding their responsibilities under IT regulations. Expressing deep concern, the court questioned the role of these platforms in allowing their infrastructure to be exploited for malicious purposes. Justice Madhav Jamdar emphasized that if intermediaries were to initiate timely action against such violations, it would effectively deter those creating these illicit materials. The court cautioned that failing to act makes these platforms complicit in the violation of the constitutional rights of the citizens of this country.
Scope of the Digital Violation
In her petition, Preity Zinta highlighted the growing menace of AI-driven manipulation. Her legal representative, Senior Advocate Venkatesh Dhond, informed the court that approximately 275 websites are currently hosting AI-generated images and videos that utilize the actress's likeness without any authorization. The petition argued that this content is a gross violation of Zinta's personality rights, publicity rights, and moral rights, necessitating urgent judicial intervention.
Protecting Reputation and Legacy
The court took into special account Zinta's extensive career spanning over 25 years in the film industry and the reputation she has meticulously built over the decades. The bench observed that the unauthorized use of her image, facial features, and expressions via AI technology could cause irreparable harm to her professional standing and personal dignity. By mandating the immediate removal of these materials, the court has sent a strong signal that digital exploitation will be treated with the legal gravity it demands, safeguarding celebrity rights in the era of advanced AI threats.
