PRAYAGRAJ: The Allahabad High Court has firmly established in a recent ruling that parental anxieties cannot supersede the constitutional freedom granted to an adult to choose their own life partner. Justice Sandeep Jain directed local authorities to ensure the complete safety and security of an 18-year-old woman and her husband, emphasizing that personal autonomy and the right to select a spouse are integral components of individual liberty and dignity that the state and its institutions must respect.
Background of the Legal Dispute
During the court proceedings, the counsel representing the woman's husband argued that she is the legally wedded wife of his client Mohit, and that their marriage took place against the wishes of their families. The lawyer alleged that following the wedding, the young woman was unlawfully detained by her father and relatives. When local authorities failed to register an FIR regarding the matter, the woman herself approached a competent court in Budaun on July 20, 2026, under Section 173(4) of the Bharatiya Nagarik Suraksha Sanhita, seeking legal action against her father and relatives.
Stance of the Family and State
Conversely, the woman's father contested the claim that his daughter had married Mohit, maintaining that she was residing in her parental home of her own free will and was not being held against her wishes. Counsel representing the state government informed the court that a missing person report had initially been filed by the father, following which the young woman was traced and handed back over to him.

Earlier on August 31, after reviewing relevant documents, the High Court noted that the individual had attained majority and was therefore fully entitled to choose her partner and place of residence. To verify whether she was staying with her family voluntarily or under coercion, the bench instructed authorities to produce her in court. The woman stated before the court that she was born on June 8, 2008, and had legally attained adulthood. She affirmed that she married Mohit out of her own accord on July 18, 2026, and expressed her clear desire to live with him as his wife. The husband similarly confirmed the marriage and his wish to live with her. Furthermore, the father acknowledged during the hearing that his daughter had indeed reached the age of majority.
