The High Court of Chhattisgarh delivered a key judgment clarifying procedural rights in matrimonial maintenance disputes. The court ruled that a husband holds a complete legal right to cross-examine his wife regarding her income, earning sources, and financial background during maintenance litigation. In issuing this ruling, the High Court set aside an order passed by the Durg Family Court that had previously barred a husband from questioning his wife on her declared income details.
Principles of Fair Hearing and Income Verification
A single bench of the High Court observed that ensuring a fair hearing requires providing equal procedural opportunities to both contesting parties. Just as a wife possesses the right to question her husband concerning his salary, business assets, and financial capacity, the husband equally retains the right to verify the accuracy of the income statements submitted by his wife. The court highlighted that permitting thorough cross-examination helps establish the true financial status of both individuals, thereby aiding in a fair determination of maintenance obligations.
Origin of Dispute in Durg Family Court
The legal battle originates from a maintenance application filed by a woman residing in Raipur against her husband in the Family Court at Durg. As part of the ongoing proceedings, the woman submitted a formal financial affidavit detailing her income and assets to the court. However, during the course of the hearing, the Durg Family Court issued an order on 3 August restricting the husband from conducting any cross-examination regarding the financial disclosures contained in her affidavit.
High Court Challenge and Directives for Proceedings
Aggrieved by the lower court restriction, the husband approached the High Court of Chhattisgarh seeking relief. He argued in his petition that denying him the chance to test the veracity of the affidavit through cross-examination rendered him incapable of presenting an effective defense. Upon evaluating the submissions, the High Court agreed that withholding cross-examination undermined equal opportunity principles and quashed the 3 August decision.
The High Court directed the Family Court to allow the husband to cross-examine his wife on her income sources during the next scheduled hearing on 11 September. Additionally, the bench issued a specific caution that questions during the cross-examination must not be repetitively stated, ensuring the judicial process remains focused and avoids unnecessary delays.
