Official show-cause notices have been dispatched to 19 private rehabilitation centers for functioning without mandatory registration and breaching minimum care standards prescribed under the Mental Healthcare Act, 2017. Authorities confirmed that these facilities were delivering treatment and rehabilitation to individuals dealing with mental health conditions and substance addiction without obtaining the necessary approval from competent regulatory bodies.
Notice Served to Swapna Foundation and 18 Other Outlets
The regulatory action was formalized on September 9 when individual show-cause notices were delivered to the non-compliant establishments. Among the primary targets of the crackdown is the Swapna Foundation, located in Ujan Abhoynagar, Agartala. The organization stands accused of running a mental health and addiction rehabilitation setup without securing the mandatory legal clearance. Official documentation issued by the authority highlighted specific concerns regarding the deteriorating health conditions of patients admitted to the facility.
The management of Swapna Foundation has been served a strict seven-day deadline from the date of notice receipt to provide a written explanation. They must clarify why legal proceedings should not be initiated against the institution under applicable provisions of the governing legislation. The authority warned that failing to provide a convincing response or failing to co-operate with the ongoing inquiry within the stipulated seven-day timeframe will result in immediate unilateral legal proceedings without any further warnings.
In a parallel move, similar show-cause notices were served to 18 other organizations operating across the region. These entities face identical charges of rendering mental health treatment and drug rehabilitation programs without valid permission or institutional registration. Like the Swapna Foundation, these 18 facilities have also been given a seven-day window to justify their operations, failing which they face strict enforcement measures under the law.
Mandatory Compliance Under Section 65(1) and Safety Guidelines
Under Section 65(1) of the Mental Healthcare Act, 2017, the operation of any mental health establishment without prior registration from the designated competent authority is strictly illegal. The Health Department reaffirmed that registration is an absolute requirement for all rehabilitation centers operating in Tripura. Furthermore, every registered facility must strictly comply with 12 detailed regulations established under the Act.
These mandatory regulations encompass key operational metrics including patient safety protocols, adequate dietary standards, prescribed room dimensions and ventilation, barrier-free physical accessibility for persons with disabilities, and proper biomedical waste management. Recent inspections conducted by administrative teams revealed that multiple facilities were failing to comply with these statutory requirements, creating significant risks to patient wellbeing and fundamental rights. Officials emphasized that centers failing to rectify their identified deficiencies within the specified timeframe will face severe statutory penalties.
Fatal Incident at Rehab Facility Triggers State-Wide Crackdown
This widespread administrative intervention comes in the wake of intense public outrage and regulatory scrutiny following the alleged assault and tragic death of a patient at a private drug de-addiction center. The incident prompted state authorities to initiate a thorough review of all private rehabilitation facilities operating in the region.
Earlier this month, Tripura Police arrested eight individuals in connection with the fatal assault, including the owner and staff of a private de-addiction setup. Those taken into police custody include Shubham Biswas, the owner of the Swapna Foundation Drug De-addiction and Rehabilitation Centre, along with several facility employees.
According to police records, complainant Shahana Das Bhattacharjee approached the NCC police station on August 16 to lodge a formal complaint. She alleged that her husband, Tuhinsubhra Bhattacharjee, who had been admitted to the facility on August 9, was subjected to severe physical assault by the center's staff. Following the assault, he was transferred to the Agartala Government Medical College and Govind Ballabh Pant Hospital, where attending medical personnel declared him dead upon arrival.
